Ex Populus, the company behind the Ethereum-powered gaming network Xai, has initiated legal action against Elon Musk’s artificial intelligence firm, xAI, alleging trademark infringement and unfair competition. The lawsuit, filed in the Northern District of California, claims that xAI’s branding has caused significant market confusion, harming Xai’s reputation and brand identity. Xai, which has utilized the “XAI” trademark since June 2023 for its blockchain gaming ecosystem and $XAI token, argues that Musk’s xAI, announced in July 2023, has encroached on its established market presence, particularly after xAI revealed plans for a gaming studio in November 2024.
The core issue lies in the overlapping names, which Xai contends has led to widespread consumer and media confusion. Examples include media outlets mistakenly using Xai’s logo for xAI-related coverage and xAI’s chatbot, Grok, incorrectly linking the two entities. This confusion intensified when Musk’s gaming studio announcement garnered over 36 million views, amplifying the mix-up in the public eye. Ex Populus asserts that this has not only diluted its brand but also tied Xai to Musk’s polarizing public image and xAI’s controversies, such as Grok’s reported offensive outputs, causing reputational damage.
The lawsuit further alleges that xAI’s legal team attempted to pressure Ex Populus into surrendering its trademark rights by threatening cancellation proceedings. The U.S. Patent and Trademark Office has already suspended several of xAI’s trademark applications due to potential conflicts with Xai’s prior registration. Ex Populus seeks a court order to block xAI from using the “xAI” name in gaming and blockchain contexts, cancel xAI’s pending trademark applications, and secure damages for lost goodwill and profits.
This legal battle highlights the challenges smaller innovators face when competing against tech giants in overlapping industries like AI and blockchain. For Xai, protecting its brand is crucial, especially as its $XAI token has plummeted 96.7% from its March 2024 peak.
